2. Scope and Subject of the Agreement
These Terms of Service apply to all purchases of the 365 Content Club, offered through the website https://swipeup-marketing.com.
The 365 Content Club provides digital content consisting of 365 daily viral content ideas for musicians, delivered via WhatsApp.
The offer is a one-time purchase that grants access for 12 months. Delivery begins immediately after payment.
3. Access and Delivery
Access to the service is granted instantly after purchase. Daily content is delivered via WhatsApp to the phone number provided at checkout.
The buyer is responsible for ensuring that their WhatsApp account remains active and can receive messages from SwipeUp Marketing.
4. Pricing and Payment
The total price is displayed at checkout and includes all applicable taxes.
Payment is processed immediately upon order confirmation through the selected payment provider.
Unless otherwise stated, the purchase price is a one-time payment for 365 days of access.
5. Cancellation and Refunds
You may cancel your participation at any time to stop further delivery of content.
Refunds are available only within 30 days of purchase under the money-back guarantee.
After this period, no refunds will be issued.

6. Intellectual Property
All delivered materials, including text, images, and analyses, are protected by copyright and remain the property of SwipeUp Marketing.
The customer is granted a non-transferable, non-exclusive license to use the materials for personal, non-commercial purposes only.
Sharing, reproducing, or redistributing the content is prohibited.
7. Warranty and Liability
SwipeUp Marketing strives to provide accurate and up-to-date content but does not guarantee specific outcomes such as increased reach, engagement, or revenue.
Liability for slight negligence is excluded except in cases of injury to life, body, or health.
In all other cases, liability shall be limited to foreseeable, direct damages typical for this type of contract.
8. Data Protection
Personal data is processed in accordance with our Privacy Policy.
Delivery via WhatsApp requires the processing of your phone number and message data.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes shall be Rosenheim, Germany.
10. Dispute Resolution
SwipeUp Marketing participates in a dispute resolution procedure before the Universal Arbitration Board of the Federal Government, Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, https://www.verbraucher-schlichter.de.

11. Final Provisions
If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected.
The invalid provision shall be replaced by a valid one that comes closest to the intended economic purpose.
